This bill streamlines inspections for State Veterans Homes by allowing VA certification to satisfy certain Medicare and Medicaid requirements to reduce administrative redundancy.
The State Veterans Homes Inspection Simplification Act aims to reduce administrative redundancy and streamline the certification process for State Veterans Homes. Currently, these facilities may be subject to multiple overlapping inspections to meet different federal requirements. This bill allows State Veterans Homes certified by the Department of Veterans Affairs (VA) to be "deemed" in compliance with specific Medicare and Medicaid requirements, effectively eliminating the need for duplicative inspections by the Centers for Medicare & Medicaid Services (CMS).
The bill amends the Social Security Act to allow a State home to be deemed compliant with Medicare "Conditions of Participation" and Medicaid requirements if it is inspected and certified by the VA, provided that:
* Documentation: The VA provides the Secretary of Health and Human Services (HHS) with full inspection reports, including survey findings, deficiencies, and corrective actions.
* Regular Review: Every two years, the VA and CMS must jointly review inspection standards to ensure they remain aligned.
* Standard Parity: The VAโs inspection and enforcement processes must, at a minimum, match the protocols and resident care, safety, and transparency standards required by CMS.
To ensure resident safety is not compromised by this simplification, the Secretary of HHS retains the authority to:
* Conduct independent complaint investigations or targeted surveys.
* Impose civil monetary penalties or terminate a facility's participation in Medicare/Medicaid.
* Revoke the "deemed" status if the VA's certification process is found to be inconsistent with federal standards.
The bill ensures that veterans and their families still have access to quality data. VA inspection findings and quality metrics must be incorporated into the Nursing Home Care Compare website (or a successor platform) to maintain transparency and allow for public comparison of care quality.
